Since the EPA has long ignored the disagreement among the scientific community regarding the EPA’s classification of CO2 as a pollutant as well as the magnitude of man-made warming, industry groups contested that the courts should reverse the EPA’s ruling on the grounds that it was arbitrary and capricious.
