Sen. Jeff Sessions of Alabama, the senior Republican on the Judiciary Committee, warned senators in unusually dire terms against voting for President Barack Obama’s choice, saying, “Be careful about it, because I’m afraid that we have a dangerous, progressive, political-type nominee.”

For members of the Network of Spiritual Progressives, confirming Elena Kagan to the Supreme Court is not just a matter of law or politics. It is a spiritual imperative for the disillusioned Obama acolytes suffering from post-election politician syndrome.

Before casting a ‘no’ vote at the Judiciary Committee meeting, Sen. Sessions summarized his concerns with Elena Kagan’s nomination. Sessions said Ms. Kagan fits President Obama’s expressed desire for judges who would allow their personal and political views of “what America should be” to influence their rulings. Sessions argues that such a philosophy of judging is “the greatest threat” to the independence of the courts in our “glorious legal system,” and that judges must serve “under the constitution…not above it.”

This is a violation of the 11th Amendment of the Bill of Rights. It’s a violation of the Constitution. “The Judicial power of the United States shall not be construed to extend to any suit in law or equity, commenced or prosecuted against one of the United States by Citizens of another State, or by Citizens or Subjects of any Foreign State.”

In a 5-4 decision, the D.C. Court of Appeals held today that “We the People” do not have the right to vote on the issue of same-sex “marriage.” Penny Nance, Chief Executive Officer of Concerned Women for America (CWA), denounced the opinion.

Documents that show Kagan’s “suggested option” was used verbatim in the final “Statement on Intact Dilitation and Extraction” ACOG released on January 12, 1997, and was ultimately quoted in the Supreme Court majority opinion in the case of Stenberg vs. Carhart, striking down Nebraska’s ban on partial-birth abortion.

Already, the healthcare overhaul law, Obama’s signal achievement, is under attack in the courts. Republican attorneys general from 20 states have sued, insisting the law and its mandate to buy health insurance exceed Congress’ power and trample on states’ rights.

Clearly, however, the socialist movement has risen again, under the cover of the “progressive” tradition that includes not only the President who appointed Kagan but her backers at the George Soros-funded Center for American Progress (CAP).
